Federal High Court declares bank charges illegal

A Federal High Court in Lagos has ruled that the provisions of the The Central Bank of Nigeria’s circular reference CBN/GEN/DMB/02/006 of 15th January 2016 are inconsistent with Schedule 1 of the Stamp Duties Act, Cap 54, Laws of the Federation of Nigeria 2004 and are invalid, null and void.

The FHC presided over by Mr. Justice (Prof.) Chaka Austin Obiozor, in its judgment of 13 March 2017, in the case of Retail Supermarkets Nigeria Limited vs. Citibank Nigeria Limited and Central Bank of Nigeria (suit no. FHC/L/CS/126/2016), granted an order of perpetual injunction restraining the the first defendant either by itself, its agents, servants, privies, assigns or any person claiming through or deriving authority from it, from taking any step to implement or further implementing the 2nd defendant’s circular in relation to the plaintiff’s account.

Cleatly, the Central Bank of Nigeria has no powers and authority under any Law to direct and authorise the charges and deductions. The CBN is not the National Assembly.

The Lawyers in the CBN and Financial institutions need to re-educate themselves on what the Rule of Law is about.

Enough of this governance by whims and caprices. Give public servants an inch of responsibility and they display a pound of unlawful authority.

We must demand a government of Laws.

Dangote opens one-stop shop in Onitsha

Nigeria’s most successful conglomerates, the Dangote Plc, has signed a Memorandum of Understanding, MoU, with Bontus Group of Companies based in Onitsha for the supply and distribution of all Dangote products in the commercial city.

Director in charge of Dangote in the South East, Mr. Tunde Mabogunje signed for his company, while the chairman of Bontus Group, Chief Uche Okafor, signed for his company.

Okafor said at the signing ceremony that with the agreement, all Dangote products, including sugar, cement, noodles, rice and tomato, would soon flood the eastern part of the country at very competitive prizes.

The South East director of Dangote, Mr. Mabogunje, said in addition to sugar, salt, cement and other products, his company would launch its brand of rice before December 2017, just as Dangote tomato would soon be in the market.

Related imageAccording to Punch, Department of State Services, on Thursday, in Abuja, interrogated the Group Managing Director of Capital Oil and Gas Limited, Mr. Ifeanyi Ubah, over the claim by the Nigerian National Petroleum Corporation that it had N11bn worth of Premium Motor Spirit stored in Ubah’s firm’s facility.

The NNPC had written both the DSS and the Economic and Financial Crimes Commission, asking them to help it to recover the said amount.

It said it stored the PMS with the amount in the facilities of Capital Oil and Gas Limited.

The NNPC alleged that the product was stored in the facility under a special arrangement, which it claimed was breached by the former governorship candidate of the Labour Party in Anambra State.

The corporation claimed that Ubah sold the product without its permission.

Our correspondent gathered that some officials of the corporation were also at the meeting where Ubah was questioned at the headquarters of the DSS in Asokoro, Abuja.

Security sources said Ubah was earlier invited to the DSS office on Monday where he was also asked to provide answers to the issues raised by the NNPC.

The source added, “We invited him based on the petition by the NNPC on the issue of selling of fuel and all that.

“He was with us on Monday and was also here today (Thursday) and we have been able to get to some level on the issue, but we are continuing with our investigations.

“When he came on Monday, we discussed what happened and he said there were documents to back up his own claim, because he told us that the corporation is also owing him.

“We therefore asked him to return on Thursday with the documents to back up his claim, which he did.

“We are continuing with our investigations, but we have asked all parties to go home because it was not only Ubah that was questioned or was here.”

The NNPC had stated in a statement by its Group General Manager, Public Affairs Division, Mr. Ndu Ughamadu, in Abuja some days ago that the politician’s company failed to remit the money as agreed.

Ughamadu, in the said statement, explained that the corporation’s Chief Operating Officer, Downstream, Mr. Henry Ikem-Obih, gave details of how the alleged infraction was uncovered by the NNPC earlier in the year.

Ikem-Obih had said, “We instructed the Nigerian Products Marketing Company  a subsidiary of the NNPC, to send additional trucks to those locations to move products for distribution aimed at meeting a supply shortfall we discovered in the market, but after days of not being able to access the terminals, we had to take a decision as NNPC management to invite auditors and inspectors to go and do a physical check on the inventories.”

Meanwhile, Ubah confirmed being invited by the DSS with respect to debts owed the NNPC and a legal issue with the Asset Management Corporation of Nigeria.

He said he had written to the Senate and the Economic and Financial Crimes Commission on the matter prior to the invitation by the DSS.

Ubah, in a chat, said the DSS was helping to resolve the issue, which had added had been blown out of proportion in some quarters.

He wants to salvage the situation and save the jobs of over 2,000 people. I am currently reconciling my account with all the parties concerned. I’m owing the NNPC and the NNPC is also owing me. My over three years old case with AMCON is also being looked into.”

But it would be recalled that he had denied this report that he was arrested by DSS when the news broke.

Ubah’s Chief of Staff, Mr. Chiedozie Udogu, said his principal had been going to the DSS since Monday.

“Yes, it was true that he was at the DSS office, but he was not detained. He went there for the reconciliation of account with the NNPC.

“The DSS is mediating in the trade dispute with the two parties. Therefore, it is nothing to be worried about,” he stated.

It is no longer news that senior manager of MSN GANg, Yusuf Adepitan, popularly known as Danku, has officially parted ways with one of his young artistes, Rayce, over unresolved differences. Just last week, Jebon Records, the record label of Rayce’s record label published an official press statement which stated that Danku is no longer managing Rayce, warning the public to quit transacting any form of business with Danku on behalf of Rayce or Jebon Records. He vehemently warned them to quit tarnishing his reputation and and that of his family name because he has done nothing wrong to them. Meanwhile the story of how Rayce allegely impregnated a prostitute girl and abandoned her and the baby, the girl popularly called ‘Ewa the Prostitute’ who is currently threatening to sue the Edo State born Afro-pop star and his record label also threatened to release the screenshots of some of their dirty chats if he continue to run away from his responsibility. But Rayce on his part has denied ever abandoning the girl and the baby. Why Ifeanyi Uba was arrested by DSS

Image result for Ifeanyi UbahThere are reports that operatives of the Deportment of State Services (DSS) have arrested and detained Ifeanyi Uba, the owner of Capital Oil. According to Sahara Reporters, Ubah was implicated in a corruption incident involving the Nigerian National Petroleum Corporation. It was reported that the Capital Oil owner was accused of “embezzling funds from an illegal sale of crude oil saved in his facility.”

Image result for Bukola SarakiIt has been revealed that the Senate on Tuesday said the controversial armoured Range Rover Sports car bought by the National Assembly cost $298,000 and not N298m.

The car had been linked to the Senate President, Dr. Bukola Saraki, who, on Monday, denied buying the Sports Utility Vehicle.

The importer had, however, said the documents of the car were fake.

An online news portal, SaharaReporters, which made the allegation in a report published on March 18, 2017, said the seizure of the SUV, allegedly belonging to Saraki, was the reason the Senate was moving against the Comptroller General of the NCS, Col. Hammed Ali (retd.).

The medium reported that the car was intercepted and impounded on January 11, 2017, by the service for allegedly having fake documents.

The Chairman, Senate Committee on Media and Public Affairs, Sabi Abdullahi, told journalists on Tuesday that reports on the car had been mischievous.

He said, “Our attention has been drawn to the various false and mischievous reports in the media about the price of the vehicle, which the Senate was said to have bought as part of its convoy but was later abandoned when it got impounded by the Customs over controversy surrounding import duty payment.

“The correct price of the vehicle, when it was imported in 2015, is $298,000, which at the prevailing rate of N165 to a dollar is about N49.17m. The Senate paid N62.5m for the vehicle in November 2015. This is contrary to the mischief by those who decided to turn the  $298,000 to N298m as the price of the vehicle. For the avoidance of doubt, the price of that vehicle is N62.5m and not N298m.

“The Senate will appreciate it if all reports relating to the legislative institution, particularly on this vehicle matter, are reported with accuracy and all facts put in proper perspective. We urge journalists to avoid sensationalism. The Senate is a responsible institution and those who believe that when they have issues to explain before it,  the next thing to do is to resort to falsehood, blackmail, muckraking and mud-slinging, should know that they are just overheating the polity and undermining our democratic institution.

“Finally, the Senate wishes to reiterate our total commitment to upholding the rule of law and to work for Nigerians, in accordance with our constitution.”

While appearing before the Senate Committee on Ethics, Privileges and Public Petitions on Monday, the importer, Mr. Tokunbo Akindele, confirmed that the documents of the car were fake.

He, however, stated that no letter was received from the National Assembly for the clearing of the car.

He said, “There was no document received from the National Assembly for the clearing of the car. All the documents were received on receiving the car. We have the clearing documents, which we have found were fake, and these were what were given to us. We found this out in 2017, but there is no mention to the National Assembly even on the fake documents.

“No documents were submitted by the National Assembly. And there is no correlation with Senator Bukola Saraki in terms of clearing this car and the fake documents.”

The nominations in Biggie’s house on Monday were surprising to some while others have predicted it.

The housemates went into the diary room knowing exactly who they would nominate, having discussed it earlier with their fellow housemates.

As predicted by TBoss and Debie-Rise earlier in the evening, the clique – Bally, Bisola, Efe and Marvis nominated the two of them, while they nominated Marvis and Efe.

TBoss and Debie-Rise led the nominations, as most of other housemates nominated them because they felt they had survived a number of evictions, making them possible tight competitors.

After the nominations, Debie-Rise walked in the Diary Room and told Biggie that the nominations were as expected. Her emotions got the better of her, as she cried while talking to Biggie.

Marvis also told Biggie that she saw her nomination coming.

“A few people didn’t see my nomination coming. I didn’t take it to heart. I think they (TBoss and Debie-Rise) put me up because of the comment I made about Debbie not having self-esteem,” she told Biggie.

Marvis was probably right about the other housemates not seeing her nominations coming, as Bisola said she was surprised to hear Marvis’s name amongst the nominated housemates.

TBoss also felt it was as expected. “I totally saw it coming!” she said.

She said she was not surprised that HoH Bisola saved Efe, as opposed to saving Marvis and didn’t dwell much on her statement.

Bally, on the other hand, said he was really surprised that he wasn’t put up for nomination initially, before the HoH swapped Efe for him.

“I was surprised. I really thought I’d be put up. That’s why the situation was a surprise for me. I thought Debie-Rise and TBoss would put me up and I was surprised when I didn’t hear my name. This is why it really got to me when I was replaced,” he said.

Efe was also another housemate that was surprised by the nominations.

“I thought Bisola would save Marvis because they’re close,” he said.
